1. Acceptance of Terms

These Terms & Conditions constitute a legally binding agreement between you ("Licensee", "User", or "Customer") and DEWizards Solutions & Debojeet Bhowmick ("DEWizards", "we", "us", or "our"). If you do not agree to all provisions set forth herein, you must immediately discontinue use of this website and its associated services.

2. Digital Products & Commercial Perpetual License

All proprietary source code packages, full-stack applications, UI/UX templates, and software archives sold in the DEWizards Digital Store are protected under international copyright, trademark, and intellectual property laws.

Upon verified payment, DEWizards grants you a worldwide, perpetual, non-exclusive, non-transferable Commercial Perpetual License subject to the following express conditions:

• Permitted Use: You may customize, modify, compile, and deploy the purchased source code in one (1) commercial or personal end-product for yourself or on behalf of a single client project.
• Derivative Works: You may integrate the codebase into larger bespoke client applications without owing recurring royalties.
• Prohibited Resale: You are strictly forbidden from distributing, sublicensing, reselling, renting, donating, or making publicly accessible the raw source code archive (.ZIP) or substantial parts thereof, whether unmodified or modified, as a competing digital template, starter kit, or downloadable asset.
• No Plagiarism: You may not falsely claim original authorship of the foundational proprietary software architecture provided by DEWizards Solutions.

3. Orders, Invoicing & Razorpay Payments

All financial transactions for digital software purchases on our platform are processed securely via our verified gateway partner, Razorpay Software Private Limited.

• Payment Authorization: By completing checkout, you confirm you are authorized to use the chosen payment instrument (UPI, Debit/Credit Card, Net Banking, or Digital Wallet) and authorize the charging of the exact displayed transaction total in Indian Rupees (INR).
• Automated Delivery: Upon server-side payment verification (verify-payment), our infrastructure issues an automated digital receipt and cryptographic download access. You may retrieve your package immediately and re-download it via our secure digital order verification portal.
• Commercial Invoices: Our serverless system automatically compiles an official commercial tax invoice (with sequential identifier INV-YYYY-XXXX) documenting transaction timestamp, customer details, and tax breakdowns.
• Backup Responsibility: The customer is responsible for downloading and maintaining secure local backup copies of purchased digital packages upon receipt.

4. Technical Blog, Interactive Polls & Embedded Media

DEWizards provides technical articles, engineering tutorials, and interactive reader features.

• Reader Polls: Reader participation in community polls is strictly subject to honest engagement. Automated vote stuffing, bot ballot manipulation, or scripting against our poll aggregation endpoints (vote-poll) is prohibited.
• Embedded Video Content: Video materials, including YouTube long-form demonstrations and YouTube Shorts embedded within articles, are hosted by third-party platforms and remain subject to the YouTube Terms of Service and Google Privacy Policies.
• Educational Nature: Code snippets and architectural explanations published in blog articles are shared for educational purposes. Users are advised to review code safety prior to production deployment.

5. Newsletter Subscriptions

Subscribers to our email dispatch agree to receive periodic technical writings, software release alerts, and curated developer updates. Subscriptions are voluntary and can be cancelled at any moment via the automated one-click unsubscribe mechanism in emails or by contacting support.

6. Cybersecurity & Acceptable Use Policy

You agree not to engage in any activity that compromises the security, stability, or integrity of the DEWizards infrastructure. Prohibited actions include:

• Attempting to bypass, disable, or circumvent Netlify Edge rate limits, hCaptcha challenges, or cryptographic HMAC cookies (dewizards_vid).
• Reverse-engineering, spoofing, or tampering with payment verification webhooks or download token generators.
• Conducting automated scraping, crawling, or systematic data extraction without prior written authorization.
• Injecting malicious payloads, SQL commands, cross-site scripting (XSS), or automated denial-of-service traffic into any form or API endpoint.

7. Warranties & Limitation of Liability

Digital products and services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. DEWizards Solutions does not guarantee that the software will be completely error-free or operate uninterrupted across every custom third-party operating environment or hosting tier.

To the maximum extent permitted by applicable law, DEWizards Solutions and Debojeet Bhowmick shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from the use of, or inability to use, our website, code packages, or digital services. Our aggregate liability shall not exceed the actual amount paid by the customer for the specific product in dispute.

8. License Termination

Any breach of these Terms, including unlawful distribution of licensed source code or attempting unauthorized platform intrusion, shall result in immediate and automatic revocation of your commercial software license without entitlement to refund, and may subject the violator to civil and criminal prosecution.

9. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, controversy, or claim arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the competent courts in West Bengal, India.
